•Catalog/Property Descriptions: We have gathered the information provided from the seller. Please use due diligence to inspect items and property. There is no warranties, expressed or implied. Property is sold in "as is" condition and it is the bidders responsibility to be satisfied with conditions before placing a bid.
•Payment: Cash, or good check at the close of sale. All payments shall be made payable to Chuck Marshall Auction and Real Estate. There is a 10% buyer's premium added to the total purchase. All sales are final and there will be no credit charge backs permitted.
•Default of buyer: Successful bidder not paying for items at the end of the auction will be considered in default. Such default by the successful bidder will results in that bidder's liability to both the seller and the auction company. Seller shall have the right to (a) declare this contractual agreement cancelled and recover full damage for its breach (b) to elect to affirm this contractual agreement and enforce its specific performance or (c) seller can resell the items either publicly or privately with the auction company and in such an event, the buyer shall be liable for payment of any deficiency realized from the second sale plus all cost, including, but not limited to the holding/transporting/storage cost of the items, the expenses of both sales, legal and incidental damages of both the seller and the auction company. In addition, the auction company also reserves the right to recover any damages separately from the breach of the buyer. The purchaser agrees to pay all reasonable attorney fees and cost incurred the auction company in the collection of funds. The purchaser also agrees that a storage/handling fee of 2% per month to be added to the balance of any unpaid balance due to the auction company and any other cost or losses incurred by the buyer's failure to adhere to these terms. Any debt collection or dispute proceedings will be litigated or arbitrated in Fleming Co Court at the option of both the seller and the auction company. Both the successful bidder and seller shall indemnify and hold harmless the auction company from any cost, losses, liabilities, or expenses, including attorney fees resulting from the auction company being names as a party to any legal action resulting from either bidders or sellers failure to fulfill any obligations and undertakings as set forth in this contractual agreement.
•Chuck Marshall Auction and Real Estate Company, nor the software company hosting the auction will be held responsible for missed bids related to internet or software difficulties. Auction company reserves the right to extend an auction or cancel at its discretion.
